Introduction

StudentPlanet, Inc. (StudentPlanet) is a nonprofit 501(c)(3) that owns and operates the website StudentPlanet.org, and we want it to be a cooperative and educational online destination for all users. For this, users must be responsible and accountable for their actions. You are responsible for what you do on StudentPlanet.org and you should be aware that StudentPlanet is not responsible for your use of StudentPlanet.org. If you are a student, make sure to review the following terms and conditions concerning your use of StudentPlanet.org along with your Teacher and your parents or legal guardians. We may revise these Terms of Use and our Privacy Policy at any time by posting the revised Terms of Use or Privacy Policy on the StudentPlanet.org site with 60 days notice. BY USING STUDENTPLANET.ORG YOU AGREE TO FOLLOW AND BE BOUND BY THESE TERMS OF USE AND OUR PRIVACY POLICY AND ANY REVISIONS WE MAY MAKE TO THESE TERMS OF USE OR PRIVACY POLICY.

We Have Permission to Show Your Work on StudentPlanet.org

StudentPlanet.org is a place where people interact and often share their work. To make StudentPlanet.org a great place for all users to share we have to be able to post the work you do. By posting any content that you create, you are granting us permission to make it available and display it for use by all other users.

No Lies Allowed

You may not create or transmit any content that is false or misleading.

Respect Others

You may not create or transmit any content that harasses or invades someone else's privacy, is hateful or promotes bigotry, or encourages harm against anyone.

No Bad Language or Pictures

You may not create or transmit any content that is obscene or offensive.

Ask for Permission when Borrowing Other Peoples Work

You may not create or transmit any content that violates another's rights, including intellectual property rights or privacy rights. You need to be especially careful about copying someone else's work without their permission since this could infringe that person's copyright. Should any third party believe that their work is being unfairly used on StudentPlanet.org, they should follow the instructions found at http://studentplanet.org/legal/copyright.php.

No Advertising

You may not create or transmit any content that is advertising, promotional material, "spam", or any other form of solicitation.

No Viruses

You may not create or transmit any content that contains software virus or any computer code or files designed to interrupt, destroy or limit the functionality of any computer software or hardware.

Content May Be Viewed By Others

Remember that the content you create or transmit, may be viewed by other teachers and students on the StudentPlanet.org system and by moderators of an organization where your school has expressly given them permission to do so. While StudentPlanet is under no obligation to review content on StudentPlanet.org or monitor StudentPlanet.org, we may do so if we think it is appropriate and may elect to remove content in our sole discretion.

Content Ownership and Rights

You retain all ownership rights to your content. StudentPlanet does not claim ownership of any content you publish on StudentPlanet.org. When you publish your content on StudentPlanet.org, you grant StudentPlanet a worldwide, royalty-free, and non-exclusive license to reproduce, modify, distribute, transmit and display the content. StudentPlanet may use this license solely for the following purposes: (a) to promote and market StudentPlanet's products and services; or (b) to produce and sell derivative works based on your content in connection with StudentPlanet's products and services. Furthermore, when you publish your content on StudentPlanet.org, you also grant other users of StudentPlanet.org a limited license to download your content for their own use, solely in connection with school activity, and with no right to reproduce, modify, further display or distribute the content.

Use of Images

You are responsible for obtaining permission from others (your friends, your teachers, etc.) before you take a picture or make a video in which they are featured, and before you upload the picture or video to the StudentPlanet.org website. By uploading pictures and videos on StudentPlanet.org, you grant StudentPlanet the right to use and display your image and voice, and that of the other individuals who may be displayed on these pictures or video. You also represent and warrant to StudentPlanet that you have obtained the other individuals' permission to use their image and voice. StudentPlanet reserves the explicit right to reproduce, modify, distribute, transmit and display images and sound recordings of you and images and sound recordings of others that you have uploaded to StudenPlanet.org.

Content Can Be Removed or Changed

You agree that StudentPlanet may decide at any time to: (a) remove content (e.g., images, video, sound, text, etc.), information or material from StudentPlanet.org; or (b) make changes to or discontinue any and all aspects of StudentPlanet.org. If you have any questions about any content that is removed or flagged for potential removal, please see your Teacher or your school's Administrator for StudentPlanet.org.

Protect Your Password

You need a password to use StudentPlanet.org, and you are in charge of keeping that password secret. Make sure you log out of StudentPlanet.org when you finish using the site. If you lose your password, or you think someone else knows what your password is, tell your Teacher or your school's Administrator for StudentPlanet.org immediately. You will be held responsible for any use of StudentPlanet.org made under your name and password.

Protect Your Information

As a member of StudentPlanet.org, you should be very careful about sharing information about you or your friends. If somebody makes you uncomfortable by asking for information about you or your friends, tell your Teacher immediately. No personal information obtained from StudentPlanet.org may be shared with third parties without the prior written consent of the person whose personal information you want to share.

Privacy

Your personal information will be protected according to our Privacy Policy.

Account Termination

StudentPlanet can cancel your StudentPlanet.org account at any time. If you want to cancel your account, please talk to your school's Administrator for StudentPlanet.org. For more information about canceling your account, please contact StudentPlanet.org by clicking on the Contact link at http://studentplanet.org.

Reporting Misuse

If you see, hear or become aware of something on the StudentPlanet.org website that you think is inappropriate, tell your Teacher immediately. Your Teacher should speak with your school's Administrator for StudentPlanet.org to determine how to handle the situation.

THE CONTENT, INFORMATION OR MATERIAL CONTAINED IN STUDENTPLANET.ORG MAY BE OUT OF DATE OR INCLUDE OMISSIONS, INACCURACIES OR OTHER ERRORS, AND YOU SHALL NOT RELY ON IT. TO THE EXTENT PERMITTED BY LAW, ALL CONTENT, INFORMATION AND MATERIAL ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. STUDENTPLANET, ITS AFFILIATES, AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS HEREBY DISCLAIM ALL WARRANTIES WITH RESPECT TO STUDENTPLANET.ORG, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF ANY THIRD PARTY'S INTELLECTUAL PROPERTY RIGHTS.

Limitation of Liability

IN NO EVENT SHALL STUDENTPLANET, ITS AFFILIATES, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA OR USE, INCURRED BY YOU OR ANY THIRD PARTY, WHETHER IN AN ACTION IN CONTRACT OR TORT, ARISING FROM YOUR ACCESS TO, OR USE OF, STUDENTPLANET.ORG.

Indemnity

You shall defend, indemnify and hold harmless StudentPlanet, its affiliates, and their officers, directors, employees and agents from and against any and all claims, liabilities, damages, losses or expenses, including reasonable attorneys fees and costs, arising out of or in any way connected with your access to or use of StudentPlanet.org.

StudentPlanet.org may contain hyperlinks to websites controlled by parties other than StudentPlanet. Your use of these other sites is subject to the Terms of Use and Privacy Policies of these sites, which may differ from those of StudentPlanet.org. StudentPlanet is not responsible for and does not endorse or accept any responsibility over the content or use of these websites. You should refer to the policies posted by other websites regarding privacy and other topics before you use them.

Applicable Laws

All matters relating to your access to, or use, of StudentPlanet.org shall be governed by U.S. federal law or the laws of the State of California. Any legal action or proceeding relating to your access to, or use of, StudentPlanet.org shall be instituted in a state or federal court in Santa Clara County, California. You and StudentPlanet agree to submit to the jurisdiction of, and agree that venue is proper in, these courts in any such legal action or proceeding.
